Judge Kenneth J. Vampola gritted his teeth as he reluctantly sentenced a Fremont man to time served and a fine for third-degree domestic assault.
"You can plan on going to jail if you ever touch her again," Vampola told Donald Schaefer Monday in Dodge County Court.
Schaefer, 43, was sentenced to nine days in jail and the judge gave him credit for nine days served for the Class III misdemeanor. He also was fined $250 plus $41.50 in court costs.
Schaefer was arrested by the Fremont Police on Nov. 24 for striking his girlfriend at their Fremont residence.
Other cases heard Monday included:
* Michelle L. Adcock, 38, of Fremont had her arraignment for driving under suspension and unlawful display of license plates continued until May 3. Vampola continued the hearing to allow Adcock to obtain her driver's license. She was stopped by Fremont Police for the Class III misdemeanors on Feb. 24.
* The arraignment of Roger L. Anderson, 51, of Hoskins for driving under suspension was continued until May 3 so he could re-obtain his driver's license. Anderson originally was cited by the Nebraska State Patrol on Feb. 15 for the Class III misdemeanor.
* Nicholas J. Busch, 20, of St. Paul pleaded guilty to writing an insufficient funds check of less than $100, a Class II misdemeanor. Court records show Busch wrote a $20 check on April 28, 2003, without having the money in his account. He was required to pay $81.50 in restitution, a $100 fine and $41.50 in court costs.
* An April 12 preliminary hearing was scheduled for Jamey Crawford, 29, of Fremont, who is charged with possessing a controlled substance-methamphetamine and possessing a controlled substance-acetaminophen with codeine, both Class IV felonies, and criminal trespass, criminal mischief and obstructing a police officer, all Class I misdemeanors. He was arrested on July 16 by Fremont police.
* A bench warrant was issued for Randy A Dasher, 38, of Omaha for failure to appear in court Monday. Dasher was to be arraigned for theft by unlawful taking of more than $1,500, a class III felony, stemming from a Sept. 8 arrest by the Dodge County Sheriff's Office. Bond will be set at 10 percent of $50,000 once Dasher is caught.
* David L. Dryden, 38, of Fremont pleaded guilty to driving under suspension, a Class III felony. His driver's license was revoked for one year and he was fined $100 plus $41.50 in court costs.
* A bench warrant was issued for Charles Foster, 21, of Fremont for failure to appear in court Monday. He is charged with theft of lost property less than $200, a Class III misdemeanor. Vampola set a $500 cash bond for when Foster is arrested.
* Justin Hansen, 20, of North Bend had his arraignment for two Class III felony charges continued until April. Hansen was charged by the Dodge County Sheriff's Office with burglary and theft by receiving stolen property of more than $1,500 on Feb. 25.
* Judy L. Jackson, 24, of Hooper pleaded guilty to theft by shoplifting, a Class III misdemeanor. She admitted to shoplifting two shirts and one pair of sunglasses valued at $36.90 on Feb. 26 from Maurice's in the Fremont Mall. She was fined $150 plus $41.50 in court costs. The items were recovered, so no restitution must be paid.
* Drew Kasselder, 20, of Fremont pleaded guilty to driving under the influence-first offense, a Class III misdemeanor, in exchange for a minor in possession charge being dismissed. Dodge County Attorney Mark Boyer said Kasselder had a blood alcohol content of .114 percent when Fremont Police stopped him at 3:35 a.m. on Feb. 25 . Kasselder was given a 60-day suspended sentence, placed on six months probation, fined $400 plus $41.50 in court costs and charged $150 for monthly chemical testing and probation costs. An Interlock device will be installed on his vehicle so he will have to test negative for alcohol before the vehicle will start.
* Nathan J. Kinport, 20, of Fremont, pleaded no contest to theft by shoplifting-less than $200, a Class III misdemeanor. He was fined $50 plus $41.50 in court costs. He was arrested Dec. 28 at the Wal-mart Supercenter where he was caught shoplifting six packages of playing cards worth $24.50.
* A preliminary hearing was set for April 12 for Marcus McCart, 20, of O'Neill. Between Feb. 23 and Feb. 24, he was charged in North Bend with use of a firearm in the commission of a felony and felon in possession of a firearm, both Class II felonies, burglary and possession of a stolen vehicle, both Class III felonies, and cruelty to an animal, a Class I misdemeanor. For the Class II felonies, he faces up to 50 years in prison. For the Class III felonies, he faces up to 20 years in prison and/or a fine up to $25,000.
* Rusty A. Meyer, 24, of Fremont had his arraignment continued until April 12 to allow him to hire an attorney. He was arrested by Fremont Police on Jan. 13 for driving during revocation, a Class III misdemeanor.
* Under a plea agreement, Riley D. Morton, 26, of Fremont pleaded guilty to driving under the influence-first offense in exchange for the charge being reduced from a second offense. He was sentenced to serve seven days in the Dodge County Jail with credit for one day served and fined $500 plus $41.50 in court costs. Boyer said when Fremont Police stopped Morton on Jan. 11 for weaving, fishtailing and speeding, a breath test revealed a blood alcohol content of .246 percent - more than three times the legal limit.
* A bench warrant was issued for Spencer L. Nielsen, 20, of Fremont for failure to appear. He was cited by Fremont Police on Feb. 17 for having no proof of car insurance, a Class II Misdemeanor.
* Jonathon G. Nightingale-Watson, 19, of Omaha pleaded guilty to operating an unregistered vehicle, having fictitious plates and driving left of center. A charge of having no proof of car insurance was dropped because he was insured on Feb. 26 when Fremont Police cited him. He was fined $175 for all three charges plus $41.50 in court costs.
* Nicole L. Payton, 20, of Columbus, pleaded guilty to two charges of issuing a bad check-$100 to $500, both Class I misdemeanors. She was fined $100 for each charge plus $41.50 in court costs and ordered to pay bad check fees totaling $20. She was arrested by Fremont Police on Dec. 23 for writing a bad check for more than $110 for candles at the Fremont Mall on Dec. 21 and for more than $108 for candles at the Fremont Mall on Dec. 22.
* Dustin R. Poessnecker, 24, of North Bend pleaded guilty to driving under the influence-first offense in exchange for a stop sign violation being dismissed. He was fined $400 plus court costs and more than $200 in chemical testing and probation charges. He also was ordered to complete a defensive driving course, a six-hour chemical dependency class and had his driver's license revoked for 60 days. An Interlock device will be installed in his vehicle. Boyer said when Poessnecker was stopped by the Dodge County Sheriff's Office at 1:37 a.m. on Jan. 29, a breath test revealed a blood alcohol content of .115 percent.
* A bench warrant was issued for Robert R. Ratfield, 32, of Fremont for failure to appear in court Monday. He was cited by Fremont Police Jan. 19 for possession of marijuana-less than an ounce and for not keeping his sidewalk clean.
* A preliminary hearing was set for April 12 for Brandon T. Redding, 19, of Fremont for second-degree assault, a Class IIIA felony, use of a weapon to commit a felony, a Class III felony, and minor in possession, a Class III misdemeanor. He was arrested by Fremont Police on Dec. 18. If convicted of the Class III felony, Redding could face up to 20 years in prison and/or a fine up to $25,000 fine. He could also face up to five years in prison and/or a $10,000 fine for the Class IIIA felony.
* Brooke E. Reeder, 20, of Fremont pleaded guilty to driving under the influence-first offense and violation of a protection order, both Class III misdemeanors, in exchange for a minor in possession charge and disturbing the peace charge being dismissed. A pre-sentence investigation was ordered and sentencing was set for May 10. Boyer said when Fremont Police stopped Reeder on Feb. 18, a breath test revealed a blood alcohol content of .139 percent. She was also charged by the FPD on March 19 at 4 p.m. for following her ex-boyfriend and his new girlfriend despite a protection order.
* A bench warrant was issued for Jose Rojas, no age available, of Fremont for failure to appear in court Monday. He was to appear for a motion to revoke his probation for a driving under the influence-first offense conviction stemming from a Nebraska State Patrol arrest on Feb. 15. Vampola ordered a $500 cash bond when Rojas is arrested.
* Nicholas P. Smith, 18, of Fremont was given a 60-day suspended sentence, had his driver's license impounded for 60 days, was ordered to complete 60 hours of community service and serve six months standard probation for driving under the influence-first offense. Smith pleaded guilty to the Jan. 30 charge on March 4.
* A bench warrant was issued for Jennifer J. Thomsen, 32, of Fremont for failure to appear in court Monday. She was arrested by Fremont Police on March 3 for theft by unlawful taking-less than $200, a Class II misdemeanor.
